ThreeDay Digital gives your business a phone line, a texting channel, a publishing studio and an AI that speaks for you. That is a lot of reach, and reach can be abused. This Acceptable Use Policy (“AUP”) sets out what you may not do with the Services. It is part of our Terms of Service and applies to every customer, trial user, Authorized User and reseller.
Only contact people who have agreed to hear from you, never deceive anyone, never break the law, keep our systems and other customers safe, and use your allowances the way a normal business would.
1. Why this policy exists and who it covers
Carriers, regulators and the AI providers we build on hold us responsible for how our platform is used. One customer sending spam can get a whole block of numbers filtered or a provider relationship suspended, which hurts every other business on ThreeDay. This AUP protects them, protects the people your receptionist talks to, and protects you from legal exposure. It covers everything you do through the Services: the AI receptionist, texting and calling, the Business Hub, the apps, ThreeDay Social and any integration you connect. You are responsible for your Authorized Users and, if you are a reseller, for your clients.
2. Texting and calling: consent comes first
You may only send messages or place automated calls to people who have given the consent the law requires, and you must be able to prove it. In particular, you must not:
- Send unsolicited commercial text messages, or place robocalls, AI-voice calls or prerecorded calls, to anyone who has not given prior express consent (and, for marketing in the United States, prior express written consent). In Canada this means complying with CASL and the CRTC’s Unsolicited Telecommunications Rules; in the United States, the TCPA, FCC rules and state telemarketing laws.
- Call or text numbers on the Canadian National Do Not Call List or the US National Do Not Call Registry for telemarketing purposes, or call outside the hours those rules allow.
- Import, buy, rent or scrape contact lists whose consent you did not collect yourself, or send to lists you cannot document.
- Message anyone who has opted out. The Services process STOP, UNSUBSCRIBE and similar requests automatically; you may not work around them, re-add people who opted out, or contact them from another number.
- Hide who you are. Messages and calls must identify your business, and marketing messages must include a working way to opt out.
- Send content that mobile carriers prohibit or restrict — including content related to illegal substances, weapons, gambling, adult services, high-risk financial offers or anything a carrier flags — or send content that does not match the campaign your number is registered for.
- Use the Services for political, charitable or emergency robocalls or bulk messaging without meeting the rules that apply to them.
3. Illegal, deceptive and harmful content
You may not use the Services to create, store, send or publish content, or to run any activity, that:
- Breaks the law or helps someone else break it.
- Is fraudulent, misleading or deceptive — including phishing, scams, fake reviews, false advertising, or misrepresenting who you are, what you sell or what a caller is agreeing to.
- Impersonates any person, business, government agency, carrier or ThreeDay itself, or falsely suggests an affiliation or endorsement.
- Clones or imitates a real person’s voice or likeness without their documented permission, or presents AI-generated media as real where doing so would mislead.
- Harasses, threatens, intimidates or defames anyone, or promotes violence, hatred or discrimination against a person or group.
- Is sexually explicit, exploits or endangers children in any way, or is otherwise obscene.
- Infringes someone else’s copyright, trademark, privacy or other rights, including by publishing content you do not have the rights to.
- Contains malware, or links to it.
- Breaks the rules of a platform you publish to through ThreeDay Social or any other integration.
4. Using the AI responsibly
The receptionist and the other AI features speak and act on your behalf. You must not:
- Configure the AI to deny being an AI, or to avoid disclosing it where the law or the person asking requires disclosure.
- Instruct the AI to lie to callers, to pressure or manipulate them, to collect information under false pretences, or to make promises you cannot keep.
- Use the AI to make decisions that have legal or similarly significant effects on people — such as decisions about credit, employment, housing, insurance or eligibility for care — without meaningful human review.
- Rely on the AI to give medical, legal, financial or other professional advice that you are not licensed and permitted to give, or configure it to handle emergencies (see section 5).
- Attempt to extract our system prompts, workflows or model configurations, jailbreak or override safety behaviour, or use the Services or their output to build, train or benchmark a competing AI product.
- Generate content at a volume or in a pattern intended to flood a platform, manipulate rankings, reviews or engagement, or evade a platform’s automated systems.
- Leave the AI unsupervised in ways a reasonable business would not: review transcripts, keep the knowledge base accurate, and correct mistakes when you find them.
5. Telephony misuse
Phone numbers and calling capacity are provided through regulated carriers. You must not:
- Alter, spoof or misrepresent caller ID, or present a number you are not authorized to use.
- Engage in toll fraud, traffic pumping, international revenue-share fraud, call flooding, or any scheme that generates artificial call or message traffic.
- Auto-dial, sequentially dial or war-dial numbers, or place repeated calls to the same number in a way that would harass the recipient.
- Use the receptionist line, or any number provided through the Services, as an emergency line, present it as a way to reach emergency services, or attempt to place calls to 911 or other emergency numbers through the Services.
- Evade, falsify or fail to complete carrier registration or business verification, or use a number for a purpose other than the one it was registered for.
- Resell, sublease or share numbers or calling capacity outside our reseller program, or use the Services as a general-purpose call centre or bulk messaging gateway for third parties.
- Record calls without the notice and consent the law requires in the caller’s and your own jurisdiction.
6. Security and platform integrity
To keep every customer’s data safe, you must not:
- Probe, scan or test the vulnerability of the Services or any network connected to them, or attempt to breach security or authentication measures, without our prior written permission.
- Access, or attempt to access, another customer’s account or data, or any part of the Services you have not been given access to.
- Share login credentials, sell or transfer accounts, or open multiple trial accounts to obtain free service.
- Scrape, crawl or bulk-download the Services other than through export features we provide, or interfere with the Services’ operation, rate limits or monitoring.
- Reverse engineer, decompile or copy any part of the Services, or introduce malware, bots or automated scripts that abuse the platform.
- Use the Services to attack, spam or overload any third-party system.
If you discover a security vulnerability, please tell us privately at info@threedaydigital.com with “Security” in the subject line, give us a reasonable time to fix it, and do not access or alter data that is not yours. We appreciate responsible disclosure and will not pursue good-faith researchers who follow these rules.
7. Fair use of minutes, credits and resources
Your Plan’s Receptionist Minutes, message volume, storage, AI generations and team seats are intended for the ordinary use of your own business (or, for resellers, your clients’ businesses under our program). You must not:
- Generate artificial usage — for example, keeping calls open, looping automated calls between numbers, or scripting the AI to talk to itself.
- Use one account to serve multiple unrelated businesses, or share a seat among several people, unless your Plan or a written agreement allows it.
- Use storage or generation features as a general file host, media farm or bulk-content factory unrelated to your business.
- Use an allowance in a way that degrades the Services for other customers.
If usage looks abnormal, we may throttle it, ask you to explain it, or move you to a Plan that fits it. Extra minutes and premium-model usage are billed as described in the Terms of Service.
8. Regulated industries and sensitive data
If your business is regulated — health care, finance, insurance, law, cannabis, debt collection and others — you are responsible for determining whether the Services are suitable and for any extra agreement or safeguard your rules require. Do not process information that requires a specific contractual arrangement (for example a HIPAA business associate agreement in the United States) unless we have agreed to it in writing. Do not configure the receptionist or any form to collect payment card numbers, government identification numbers, passwords or other highly sensitive data over voice or text. Do not use the Services to collect information from children.
9. Reporting abuse
If you believe a business is misusing ThreeDay — sending you messages you did not agree to, calling after you asked them to stop, impersonating someone, or anything else in this policy — email legal@threedaydigital.com with the number or account involved, the date and time, and a copy of the message where possible. Reply STOP to any text to stop receiving messages from that number. We investigate every report.
10. Enforcement
We may investigate suspected violations and take any action we consider appropriate, including warning you, removing or blocking content, throttling or disabling a feature, suspending or terminating your account, releasing a number, notifying carriers, platforms or authorities, and cooperating with their investigations. Where practical we will contact you first and give you a chance to fix the problem; where a violation is serious, creates risk for others, or is required by a carrier, regulator or court, we may act without notice. Termination for a violation of this AUP does not entitle you to a refund. You remain responsible for all charges incurred and for any harm caused by the violation, as set out in the Terms of Service. We may update this policy from time to time; the current version is always at this address, and material changes will be announced as described in the Terms.
